À propos du cours Au plus tard en février 2016, le droit des contrats français aura été réformé par voie d’ordonnance, ainsi que le prévoit la loi du 16 février 2015 relative à la modernisation et à la simplification du droit et des procédures dans les domaines de la justice et des affaires intérieures. Un projet d’ordonnance a été soumis à consultation publique au début de l’année 2015, ce qui a suscité de nombreuses observations, dont une partie a été rendue publique. A l’heure où le MOOC débutera, le texte définitif de la réforme sera connu et pourra donc être étudié. Cette réforme du droit des contrats est extrêmement importante, en ce que la matière concernée, qui n’a jamais connu depuis 1804 une refonte de cette ampleur, constitue le cœur de notre droit privé. Le droit des contrats est en effet d’application quotidienne et essentielle pour tous les citoyens et pour toutes les entreprises. Des contrats de consommation aux contrats de travail, tous les secteurs de l’économie sont concernés, de la banque à l’industrie, en passant par les services à la personne, les activités de bienfaisance, l’agriculture, les activités libérales. Le contrat est même employé en dehors de la vie économique (contrat de transaction mettant fin à un litige par exemple). What is asylum?What is the principle of non-refoulement?Who should be recognized and protected as a refugee?These questions are both ancient and contemporary.Whether you are a decision maker, a judge, a lawyer, a human rights activist, a student, a lawyer in the business law department of a private company that wants to hire or assist refugees, you will have to answer these questions. The answers are complex. They require precise theoretical and practical knowledge of national, regional and international law.The 1951 Geneva Convention on Refugees will enable you to master these questions. This Convention remains the cornerstone of international refugee protection. It is at the heart of this online course. You will analyze in detail the principle of non-refoulement, the definition of a refugee and the causes of persecution such as political opinion, race, nationality, religion or membership of a social group.This definition will allow you to identify the people who, legally, should be recognized as beneficiaries of refugee status and international protection. Using a conceptual tool, the three-scale theory , you will analyze in a rigorous and structured manner each distinct element of the refugee definition (persecution, risk, proof) as well as, in a comprehensive approach, the definition as a whole.By confronting theoretical analysis with practical situations, you will see that, if correctly interpreted, the Geneva Convention remains effective and still allows to this day the protection of many fugitives or refugees ( Flüchtling, réfugiés ).Beyond law, you will understand the value of an interdisciplinary approach, in particular when measuring the credibility of an asylum seeker’s narrative.You will examine the importance of regional, subsidiary or complementary protection in addressing armed conflict, events seriously disturbing public order or mass influxes of people in need of international protection. Course Overview:The Course is designed to give an outline of the Judicial System in India, and its development from the ancient to modern times. It covers various aspects of Supreme Court, High Courts, Constitutional Law, Civil Justice System, Criminal Justice System, Special Courts and Tribunals. La asignatura, que toma su denominación del título de la novela de Luis Vélez de Guevara, plantea analizar, de la mano de “pretextos” preparados por profesores universitarios y expertos procedentes de diversos ámbitos académicos y profesionales (arquitectura, biología, derecho, economía, historia, literatura, medicina, periodismo, sociología, etcétera), casos y materiales que evidencien la problemática de la privacidad en diversas facetas de las sociedades modernas. 家族と法は、相性が悪いと言われる。夫婦が相互に愛し合い、両親が慈愛に満ちた聡明な育児をすることが理想だとしても、法は、たとえば愛を失った配偶者に愛することを強制できない。しかし民法は、家族間の権利義務を定める。それはどのような内容で、どのような機能を果たすのだろうか。この講義では、それを考えてみたい。150年前に明治維新を迎えた日本は、欧米諸外国との不平等条約を改めるために立法作業をすすめ、120年前に明治民法を立法した。「家」制度を定めていた明治民法が、個人の尊厳と両性の本質的平等を要求した日本国憲法に従って、70年前に大改正されて「家」制度が廃止され、現在の民法になったことは、常識として知られている。しかし現在の日本民法が定める家族法であっても、モデルにしたヨーロッパの民法とは相当に異なっていることは、それほど知られていない。日本家族法の特殊性とその抱える問題性を、比較法的な観点からも検討する。
