What is asylum?What is the principle of non-refoulement?Who should be recognized and protected as a refugee?These questions are both ancient and contemporary.Whether you are a decision maker, a judge, a lawyer, a human rights activist, a student, a lawyer in the business law department of a private company that wants to hire or assist refugees, you will have to answer these questions. The answers are complex. They require precise theoretical and practical knowledge of national, regional and international law.The 1951 Geneva Convention on Refugees will enable you to master these questions. This Convention remains the cornerstone of international refugee protection. It is at the heart of this online course. You will analyze in detail the principle of non-refoulement, the definition of a refugee and the causes of persecution such as political opinion, race, nationality, religion or membership of a social group.This definition will allow you to identify the people who, legally, should be recognized as beneficiaries of refugee status and international protection. Using a conceptual tool, the three-scale theory , you will analyze in a rigorous and structured manner each distinct element of the refugee definition (persecution, risk, proof) as well as, in a comprehensive approach, the definition as a whole.By confronting theoretical analysis with practical situations, you will see that, if correctly interpreted, the Geneva Convention remains effective and still allows to this day the protection of many fugitives or refugees ( Flüchtling, réfugiés ).Beyond law, you will understand the value of an interdisciplinary approach, in particular when measuring the credibility of an asylum seeker’s narrative.You will examine the importance of regional, subsidiary or complementary protection in addressing armed conflict, events seriously disturbing public order or mass influxes of people in need of international protection. Regional protections find their source in European Law, African law or American Law.Finally, you will look at future challenges, such as the issue of climate refugees.Numerous sources will be provided throughout the course in order to help you understand the concepts such as relevant case-law, doctrine and guidelines of UNHCR and other international institutions on refugee issues and international human rights law (such as EASO).In this course, Asylum and Refugee Law, you will learn whether or not migrants can be returned to another country, whether or not they should be included in or excluded from the refugee definition, and whether or not to challenge the decision on someone’s refugee status. You will do all of this by developing a rigorous legal reasoning.

Forced marriage and domestic abuse can be a driver of migration for women and girls. Being subject to violence is also a major risk along migration routes, where sexual violence is a grave concern. In the destination country, various obstacles can place migrant women and girls more at risk of violence and exploitation, especially those who are undocumented.Addressing the root causes of forced and economic migration and ensuring that the human rights of women and girls are protected throughout the migration process (across countries of origin, transit and destination) are essential steps towards a stronger recognition of their equal dignity and of their roles in fostering a more equitable, inclusive and sustainable human development.The international community has developed over time a set of international and regional instruments that protect women and girls from violence and breaches of their human rights. To what extent do these instruments apply in the context of migration? What are the main challenges and obstacles in this area? Accessing one’s rights is vital to maintain justice in society. To activate legal mechanisms that help address grievances, it is important to know one’s fundamental rights and the extent and scope of these rights. Rainmaker has launched this course, in collaboration with the Ford Foundation, India, to bring legal literacy of basic human rights and the access to justice to a wider audience. While an individual can enrol in this course and study the content for personal use, this course can also be used in a ‘train-the-trainer’ format.This course contains ten Units where each unit is devoted to a separate topic within the subject matter of human rights law. A Unit comprises of a Reading Material and a Video Lecture. Some Units are also accompanied by Supplementary Materials that contain model formats, specific guidelines or additional information. The course aims to provide the student with a working knowledge of the legal framework governing human rights in India. It will also help the student understand special legal provisions such as the Right to Information Act, the Consumer Protection Act and similar civil law remedies.

This course examines Supreme Court decisions concerning the development of the 1st, 4th, 5th, 6th, 8th, and 14th Amendments to the United States Constitution. We will look specifically at establishment and free exercise; free speech, including obscene speech; 4th Amendment guarantees against unreasonable searches and seizures; the 5th Amendment right against self-incrimination; 8th Amendment prohibitions against cruel and usual punishment; as well as related cases that have recognized rights of historically marginalized groups in United States history, including African-Americans, women, and sexual minorities through these Amendments. Particular attention will be paid to how the Supreme Court has developed arguments which have expanded and contracted “rights” and “liberties.” We will also pay close attention to larger political contexts apart from court decisions that contribute to the overall development of “civil rights and civil liberties” in the United States.
